Customer Privacy Policy

This privacy policy applies to the processing of personal data of customers who place an order on one of the Reticgarduri.ro platforms. Reticgarduri.ro is responsible for the processing of this personal data and treats your privacy seriously. Reticgarduri.ro therefore adheres to the requirements of the General Data Protection Regulation (GDPR) related to the processing of personal data.

What personal data do we process and why?

Reticgarduri.ro processes your personal data because you use our services. We use the following personal data for the purposes below:

1. Order process

We process the personal data that you provide to us when you place an order. This personal data is necessary for the execution of the order, the confirmation of the order and for the evaluation of the order, the payment and a possible refund. The legal basis for the processing of personal data is that this data is necessary for the performance of the contract, as defined in the GDPR. We process the following personal data in the order process:

• Comments (if applicable)
• Store reviews

In addition to the above processing operations, we process the personal data you provide when you submit a review of a store. The legal basis for this is the consent you have expressed (by posting a review), as defined in the GDPR. You can withdraw your consent by contacting us at garduri@retic.ro. We process the following personal data when you post a review of a store:

• Name (if indicated)
• The review
• Customer services

When you contact our customer service department, we will use your personal data to answer your question or handle your complaint. The legal basis for processing personal data is that this operation is necessary for the performance of a contract, as defined in the GDPR. We process the following personal data for the purpose of providing customer service:

• Name
• Address details (if applicable)
• Contact details
• Payment details (if applicable)
• Comments (if applicable)
• Customer satisfaction surveys

To ensure that our services meet your preferences, any personal data you provide to our customer service department may be used for matters such as customer satisfaction surveys. The legal basis for this processing operation is that it is necessary for the pursuit of a legitimate interest of Reticgarduri.ro (customer satisfaction) as defined in the GDPR. This operation concerns the same personal data as those indicated in no. 2.

2. Marketing messages

We also process your personal data in order to send you (personalised) marketing messages and notifications. Such messages include the latest news, discounts and updates about new stores (via email or push notifications) and loyalty schemes, regardless of the format used to send these types of messages (including email and push notifications). The legal basis for this data processing operation is the consent you expressed when placing an order. Whenever you wish to change your preferences regarding the receipt of such messages and notifications, you can unsubscribe using the link provided in the respective message.

We process the following personal data for marketing purposes:

3. Cookies

And finally, we also process the personal data you provide us indirectly. Reticgarduri.ro uses cookies for functional, analytical and marketing purposes. Functional cookies are necessary for the use of the website. Cookies collect the following personal data:

• Location details
• IP address or application identifier
• System type and internet browser
• Language used on the website

The data collected through analytical and marketing cookies is not linked to other information you provide during the ordering process. Please see our Cookie Statement for more details about cookies.

4. Fraud prevention

We also process some of the above personal data to prevent fraud and other forms of misuse. The legal basis for this processing operation is that it is necessary for the pursuit of a legitimate interest of Reticgarduri.ro (fraud prevention) as defined in the GDPR.

5. Analysis

We also use your personal data to be able to fulfill our reporting obligations towards advertising companies and to be able to improve our website and our range of products and services. The legal basis for this processing operation is the pursuit of a legitimate interest of Retigarduri.ro (analysis & reporting), as defined in the GDPR. We will always ensure that the reports do not contain data that can indicate your identity.

Age

Our website is not addressed to persons under 16 years of age and we do not intend to collect personal data from website visitors who are under 16 years of age. However, we cannot verify the age of visitors. Therefore, we recommend that parents monitor their children's online activity to prevent the collection of their personal data without parental consent. If you feel that we have collected the personal data of a minor without prior consent, please contact us at garduri@retic.ro. We will subsequently delete this data.

Automated decision-making and profiling

In the performance of the contract signed with you and to improve our platform, Reticgarduri.ro uses automated decision-making and profiling operations. We use your postal code and/or location details, for example, to select available stores in your region. Reticgarduri.ro also uses automated decision-making operations in compliance with legal obligations to prevent money laundering, terrorist financing and other crimes.

When such automated decisions and/or profiling lead to a negative decision about you and you do not agree with it, you can contact us at garduri@retic.ro. We will then reassess the situation. In addition, we would be happy to hear from you suggestions on how we can improve these processes.

How long do we store personal data?

Reticgarduri.ro will not store personal data for longer than is strictly necessary for the purposes for which your personal data is collected. We will store personal data for a longer period if required by law. Reticgarduri.ro deletes most of your personal data 2 years after you have placed an order. We use this 2-year period for administrative purposes and to be able to resolve possible questions and complaints related to the order, either from you or from the stores. We store personal data that we use for reporting, analytical purposes and to prevent misuse for 20 years after you have placed an order. We cannot remove your personal data from back-up systems. But when we perform a restoration from a backup, we will delete your personal data immediately.

Sharing data with stores

Reticgarduri.ro shares your personal data (name, address and phone number details, order) with the store you have chosen, so that the store can fulfill the order. Since you are a direct customer of the store, the store will have its own responsibility and obligations regarding the processing of your personal data. If you have any questions about how the store manages your personal data, you should contact the store directly.

Sharing data with third parties (except stores)

Reticgarduri.ro will not sell your personal data to third parties and we will not disclose it to third parties unless necessary to perform the contract signed with you, for analytical and marketing purposes, or to comply with legal obligations.

Your personal data may be shared with the following entities:

• Software providers
• Implementation partners
• Companies that conduct customer satisfaction surveys

Whenever we ask third parties to process your personal data on our behalf, we will sign a data processing agreement to guarantee the same level of protection and confidentiality of your personal data. Reticgarduri.ro will continue to have ultimate responsibility for such processing operations.

Third-party websites

Our website may include links to third-party websites. When accessing such third-party websites, please note that each of these sites has its own privacy policy. Although Reticgarduri.ro takes great care in choosing the websites to which it links, we cannot assume responsibility for the way they handle your personal data.

Access to personal data, its modification and deletion

You have the right to access all personal data we collect about you, as well as the right to ask us to amend or delete your personal data. If you have the impression that we are processing personal data without a legal basis or that we are processing personal data that is not relevant to our selection process, please contact us. You can contact us at garduri@retic.ro. Reticgarduri.ro will respond to your request as soon as possible and, in any case, no later than four weeks after receiving your request.

We inform you that most personal data cannot be deleted as long as you continue to work with Reticgarduri.ro.

Advice, questions and complaints

If you have any other questions or complaints regarding the processing of your personal data, we are happy to discuss them with you. And we are also happy to hear from you any recommendations or suggestions on how we could improve our privacy policy.

Security

Reticgarduri.ro treats personal data with great responsibility and therefore we will take the necessary measures to protect personal data against misuse, loss, unauthorized access, accidental disclosure and unauthorized modification.
